Guardianship
At the Law Practice of Jackie Kong, we believe that the role of a court-appointed legal guardian is to protect the interests of a minor child or incapacitated adult.
For a minor child, we help you file for guardianship when a parent passes away or when a child needs temporary supervision until permanent placement can be found. Even though the guardian assumes full responsibility for the care of a minor child—managing their medical, legal, and financial affairs—the parents, if alive, are still required to provide financially for the care of the child. Our attorneys guide you through the process of filing the paperwork and represent you in family court.
Our attorneys can also help you step in as the court-appointed guardian for an adult who is unexpectedly incapacitated by a debilitating illness or medical condition. Since court supervises the activities of the guardian by requiring detailed reports, you may need on-going legal counsel. The guardian has the authority to manage day-to-day financial or medical affairs and the responsibility to seek out all financial benefits and coverage for which the incapacitated person qualifies, including social security, medical benefits, pension and retirement benefits, and public assistance.
